Fundamedios denuncia brutal golpe contra las libertades

En la madrugada de este jueves 16 de febrero un Tribunal constituido apresuradamente, bajo un sorteo privado (cuando la Ley ordena que sea público) y después de que una nueva Corte Nacional de Justicia se posesionara hace pocos días, falló en menos de dos horas en el caso más importante que se ha planteado en el Ecuador para la vigencia de derechos y libertades fundamentales.

Como se presumía, considerando las graves irregularidades procesales en su momento denunciadas por la defensa, el fallo es contrario a la libertad de expresión consagrada no sólo en la Constitución de la República sino en varios instrumentos internacionales de derechos humanos ratificados por el país, pues ratifica lo actuado por las instancias judiciales previas. El rechazo del Tribunal al recurso de casación planteado por El Universo, ratifica la sanción contra el diario, sus principales directivos y el articulista Emilio Palacios, quienes fueron condenados a tres años de prisión y al pago de 40 millones de dólares a favor del Presidente de la República, Rafael Correa.

Este hecho constituye la más flagrante violación al derecho que presuntamente teníamos los ecuatorianos a expresar nuestras ideas con libertad. Más allá de que se pueda estar o no de acuerdo con los términos utilizados por Emilio Palacio en su artículo de opinión, hay una cosa muy clara: se trató de expresiones sobre un tema de debate público (los trágicos sucesos del 30 de septiembre de 2010), que juzgaban las actuaciones públicas de un mandatario en asuntos de alto interés público. Reclamar en esas circunstancias el predominio absoluto del derecho al honor del funcionario "ofendido" es dejar a una sociedad entera sin la posibilidad de debatir democráticamente hechos graves y en disputa. En otras palabras, si los ecuatorianos no podemos debatir sobre los hechos del 30 de septiembre, no podemos decir que vivimos en una democracia plena.

Fundamedios considera que la sentencia contra El Universo tendrá consecuencias nefastas, no solo para el ejercicio de la libertad de expresión, sino para la vigencia de  la democracia en el Ecuador. El precedente histórico que reclama el Presidente por su acusación y sentencias obtenidas, se cumplirá como una gran paradoja, pues sin duda se trata de un hito histórico, pero totalmente negativo. Contrario a lo que el Presidente De la República ha señalado, esta fecha será recordada como aquella en la que se prevaleció la corrupción judicial, el abuso de poder, la condena a la opinión y pensamiento de los ciudadanos, al trabajo mismo de la prensa; como el día en que un mandatario acumuló fortuna a costa de los derechos ciudadanos y a punta de fallos judiciales.

Ha quedado en evidencia además la elevada temperatura social que se manifestó el día de ayer en las agresiones de los partidarios de gobierno contra ciudadanos, periodistas, cineastas, dirigentes gremiales y empresariales, llegando incluso al extremo de quemar ejemplares de periódicos, en imágenes que recuerdan épocas siniestras de la historia humana. El retrato de este ambiente se completa con los mucosos en otra audiencia judicial en Guayaquil, dónde fueron agredidos un grupo de  partidarios del Gobierno y funcionarios políticos. Todos estos hechos, los condenamos con firmeza y al mismo tiempo señalamos la evidencia de que todos los ecuatorianos hemos perdido con el enjuiciamiento a Diario El Universo.

Fundamedios expresa toda nuestra solidaridad con los periodistas, trabajadores y directivos de Diario El Universo y resaltamos la dignidad demostrada en todo este episodio.

Fundamedios denuncia con firmeza lo ocurrido, levantando su voz de protesta y ratificando su compromiso, sin renunciamientos ni retrocesos, en la lucha por la recuperación, para el Ecuador y la Región, de los principios esenciales de una democracia plena, que en esta fecha han sido golpeados brutalmente.

During the early hours of Thursday 16 February, a Tribunal that was constituted in a hurry through a private draw (when the Law establishes it should be public), days after a new National Court of Justice was established, ruled in less than two hours in the most important case ever to be heard in Ecuador involving the effectiveness of fundamental rights and liberties.

As was expected, bearing in mind the serious procedural irregularities denounced by the defense at the time they occurred, the ruling, which sanctions the actions of previous judicial instances, opposes the freedom of expression as established not just in the Republic’s Constitution, but in several international human rights agreements ratified by the country.The Tribunal’s rejection of the appeal for the review of facts presented by El Universo, confirms the sanction against the newspaper, its main executives and feature writer Emilio Palacio, who were convicted to three years in prison and the payment of 40 million dollars in favor of the President of the Republic, Rafael Correa.

This constitutes the most flagrant violation of the right, which all Ecuadorians believed we had, to express our ideas freely. Whether a person agrees or not with the terms used by Emilio Palacio in his opinion article, one thing remains clear:they were expressions about an issue that was being publicly debated (the tragic events of 30 September 2010), which judged the public actions of a ruler in matters of great public interest.To claim in those circumstances that the “offended” official’s right to honor must prevail completely, is to leave a whole society without the right to debate democratically the serious events at issue.In other words, if Ecuadorians cannot debate the events of 30 September, we cannot say that we live in a full democracy.

Fundamedios believes that the sentence against El Universo will have calamitous consequences, not just for the exercise of the freedom of expression, but also for the effectiveness of democracy in Ecuador.The historical precedent demanded by the president through his accusation and the sentences obtained will come paradoxically true, because although it is undoubtedly a historical milestone, it is completely negative one. Against what the President of the Republic has stated, this date will be remembered as the day in which judicial corruption, the abuse of power, the condemnation of citizens’ thoughts and opinions and of the work of the press itself, all prevailed; as the day in which a ruler made a fortune at the expense of citizens’ rights and by means of judicial rulings.

What has also become evident is the high level of social turmoil now existing, which was manifested yesterday in the aggressions by government partisans against other citizens, journalists, filmmakers, union leaders and company executives. They reached the extreme of burning newspaper copies, creating images that reminded us of ominous times in human history.This image was completed by the violent acts which took place during a different judicial hearing in Guayaquil, where a group of government partisans and political officials were attacked.We strongly condemn all these events while stating it is evident that as Ecuadorians we have all lost with the indictment of El Universo.

Fundamedios expresses its complete solidarity with the newspaper’s journalists, workers and executives, and highlights the dignity they have shown during this whole episode.

Fundamedios strongly denounces what has happened, raising its voice in protest and ratifying its commitment, without renunciation or recoil, to the fight for the recovery, for Ecuador and the region, of the fundamental principles of a full democracy, which have received a brutal blow on this date.
